Do I need a permit in Seabrook, and who pulls it?

New Hampshire has one building code for the whole state. Under RSA 155-A the State Building Code, the 2024 International Residential Code for one- and two-family homes and the 2023 National Electrical Code, each with New Hampshire amendments, applies in every city and town, and a permit is required before work covered by the code begins. What differs from town to town is the office that issues it: the state leaves permits, inspections and fees to each municipality, which is why this page starts with the Seabrook building department.

Who applies is more open than in some states. The code lets the owner or the owner's authorized agent apply for a building permit, and New Hampshire issues no statewide general contractor licence. The trades are another matter: electrical installations need a licensed electrician, and gas fitting and plumbing need a licence from the Mechanical Licensing Board, in each case with a permit and inspection. The statute is explicit that the contractor is responsible for meeting the code, so the usual arrangement is that the contractor doing the work pulls the permit under their own licence.

Heating and cooling in SeabrookReplacing a furnace, boiler or water heater, or installing a heat pump, ductless mini split or central air conditioner, is permitted work in New Hampshire: the code requires a permit to install, alter or replace any mechanical, gas or electrical system it regulates, and only portable appliances and minor part replacements are exempt. Anything on the gas side, a gas furnace, boiler, water heater or the piping to it, is fuel gas fitting, licensed by the state's Mechanical Licensing Board, and the wiring to a heat pump, mini split or condenser is an electrical installation that needs a licensed electrician.Read more

Ask the Seabrook building department which permits it issues for the equipment itself; the contractor pulling them is expected to know.

New Hampshire has no separate HVAC contractor licence: the state's Mechanical Licensing Board licenses fuel gas fitters and plumbers, and oil heating technicians only on a voluntary basis, so do not expect an HVAC licence number. What you should expect is a fuel gas fitter licence on the gas work and an electrician's licence on the wiring, each with its own permit on file. The state also bars any town from restricting your choice of heating system or fuel supplier, so the decision between oil, propane, natural gas and a heat pump is yours.

If you are counting on an NHSaves rebate for a heat pump or central air conditioner, the conditions are the utility program's: a residential electric customer of Eversource, Liberty, Unitil or the New Hampshire Electric Co-op, equipment that meets the efficiency minimums, an install within the program year, and for the enhanced heat pump rebate a pre-verification before the install. A permitted, inspected installation is how the town documents the work; it does not replace the rebate paperwork.

Windows and doors in SeabrookReplacing windows or exterior doors is not on the code's list of work exempt from a permit, that list is finish work such as painting, tiling, cabinets and counter tops, small detached sheds, fences and low decks, so plan on a permit in Seabrook. The code's own exception for ordinary repairs stops at anything that removes or changes a required means of egress, which is exactly what a bedroom window is, and enlarging or shrinking an opening alters the structure.Read more

Whether a strict like-for-like swap in the same opening counts as an ordinary repair is the Seabrook building department's call, so ask before assuming.

New Hampshire issues no statewide licence for window or door installers, so the permit is the record of the work: it is issued by the town under the state code, and the owner or the contractor as the owner's agent applies for it. If Seabrook has a historic district, the state statute leaves historic district ordinances fully in force, so exterior window and door changes inside one usually need the historic district commission's approval before the building permit issues.

Roofing in SeabrookRe-roofing and roof replacement are not among the projects the code exempts from a permit, so in Seabrook treat a roof job as permitted work: the code requires a permit to alter or repair a building, and its ordinary-repairs exception is written for minor work, not for stripping and replacing the weather envelope. The town issues the permit under the state code, and the statute makes the contractor responsible for meeting it.Read more

The code has requirements for roof coverings, underlayment and ice barrier that the inspector checks against, and New Hampshire adopts them with its own amendments: the 2024 edition from 1 July 2026, with permits accepted under either the 2021 or the 2024 code until the end of 2026. Rather than quote them here, ask the Seabrook building department what it inspects for on a re-roof; the contractor pulling the permit is expected to know.

Siding in SeabrookResiding a house is not on the code's list of permit-exempt work, so in Seabrook plan on a building permit for siding replacement. The exemption covers finish work, painting, papering, tiling, carpet, cabinets, and small accessory structures, not the recladding of a building's exterior; the Seabrook building department decides where the line between a patch and a replacement falls, and the contractor pulling the permit is expected to ask.Read more

No statewide licence covers siding contractors in New Hampshire, so the town's permit and inspection are the record that the work was done to code, with the contractor responsible under the statute for meeting it. If Seabrook has a historic district, a change of siding material or profile on a building inside it usually needs the historic district commission's approval first; the state code leaves those local ordinances in force.

Before you plan work in Seabrook

Seabrook's Building Department and Code Enforcement office at 99 Lafayette Road takes building permit applications online through its permitting tab, with the forms also posted: residential, one- and two-dwelling, commercial, accessory dwelling unit and manufactured home permits, electrical, plumbing, mechanical and gas permits, demolition and sign permits, the state residential energy code application and the certificate of occupancy form. The office is open weekdays with a late Wednesday and a short Friday and a half-hour lunch closure, and its mission is the fair and equal administration of the state's and the town's building codes.

Frequently asked questions

Do I need a permit to replace my furnace, boiler or AC in Seabrook?

Yes. The New Hampshire building code requires a permit to install, alter or replace a mechanical, gas or electrical system, and only portable appliances and minor part replacements are exempt. Gas equipment is fuel gas fitting, licensed by the state's Mechanical Licensing Board; the wiring to a heat pump or condenser needs a licensed electrician, and Seabrook issues the permits. The contractor doing the work normally pulls them.

Do I need a permit to install a heat pump or mini split in New Hampshire?

Yes. The electrical connection is an electrical installation that needs a licensed electrician and an electrical permit from the town, and the equipment itself is mechanical work the code regulates. NHSaves rebates are the utility program's business, with their own equipment and paperwork conditions; they do not replace the permit.

Do I need a permit to replace windows in New Hampshire?

Plan on it. Window and door replacement is not on the code's list of permit-exempt work, and the ordinary-repairs exception excludes anything that removes or changes a required egress, which a bedroom window is. Whether a same-size swap counts as an ordinary repair is the local building department's call.

Do I need a permit to replace siding in New Hampshire?

Plan on it. Residing a house is not among the projects the code exempts from a permit; the exemption covers finish work like painting and tiling, not recladding the exterior. The local building department settles borderline cases and issues the permit.

Do I need a permit to replace my roof in Seabrook?

Yes. Re-roofing is not exempt under the New Hampshire building code, so Seabrook will expect a building permit before the work starts, and the contractor is responsible under RSA 155-A for meeting the code's roofing requirements.

How long is a building permit good for in New Hampshire?

Under the International Residential Code as adopted by New Hampshire (section R105.5), a permit becomes invalid if the work has not started within 180 days of issue, or if more than 180 days pass between inspections once work has begun; the building official may grant written extensions of up to 180 days at a time. An application that is filed but not pursued is treated as abandoned after 180 days.

Are building permits public record, and how do I look one up for an address in Seabrook?

Yes, permits are public records. Ask the building department in Seabrook how to search by address, or check the town's online portal if it has one. The recent filings table on this page shows the same public data with the street, date and permit type.

Can a homeowner pull their own permit in New Hampshire?

Often, yes. The code lets the owner apply for the building permit, and New Hampshire's licensing statutes let the owner-occupant of a single-family home do their own electrical installations and, in an existing single-family primary residence, their own fuel gas fitting: still under a permit, to code and with the town's inspection. A licence is required for anyone else doing that work. Most homeowners still let the contractor pull the permit, because the statute makes the contractor responsible for meeting the code on the work they do.

What happens if work is done without a permit?

The town can order the work stopped, opened up for inspection, corrected or removed, and the code provides penalties for building or altering without a permit. Unpermitted work also surfaces at sale, when a buyer's attorney searches the permit history. It is far cheaper to permit it the first time.
