Do I need a permit in Manchester-by-the-Sea, and who pulls it?

In Massachusetts, most permits are pulled by the licensed contractor doing the work, not the homeowner. For one- and two-family homes the state building code requires a licensed construction supervisor or a registered design professional to oversee construction, and for existing owner-occupied one- to four-family homes the contractor must also be registered with the Home Improvement Contractor program.

The homeowner exception is narrow. The building code lets an owner-occupant of a one- or two-family home apply for a building permit for work on their own home, but it applies to building permits only: electrical work may only be done by a master or journeyman electrician licensed by the state, and plumbing and gas work only by a licensed plumber or gas fitter, each under a permit issued to that licensee. It also has a cost the state warns about directly: a homeowner who pulls the building permit themselves may not be eligible for the Guaranty Fund if the contractor's work goes wrong.

The electrical side of a heat pump, mini split or AC condenser needs an electrical permit pulled by a licensed electrician. Your Manchester-by-the-Sea building department may also require a mechanical permit for the equipment itself; the contractor pulls that too.

Heating and cooling installers are one of the trades mass.gov specifically exempts from Home Improvement Contractor registration, so do not expect an HIC number from an HVAC company. What you should expect is a gas-fitter or plumber licence for gas equipment and an electrician's licence for the wiring, with a permit on file for each.

If you are counting on a Mass Save rebate for a heat pump, the equipment must be installed by a contractor participating in the Mass Save Heat Pump Installer Network. A permit trail is part of how that work is documented, so an unlicensed, unpermitted install can cost you the rebate as well as the inspection.

Before you plan work in Manchester-by-the-Sea

Manchester-by-the-Sea requires building, electrical, plumbing and gas permits to be applied for online through its OpenGov portal, though the Building Department says its staff will still help with an application. The Building Inspector keeps Town Hall hours on Tuesday from 7 to 8 am and Thursday from 4:30 to 6:30 pm. Plumbing, gas and electrical inspections are arranged with each inspector directly; the department asks you to contact the individual inspector for hours.

The Manchester Historic District, established under Chapter 40C in 1975, takes in lots on Ashland Avenue, part of Bridge Street, Central Street, Church Street, Union Street and Washington Street, and one lot on Summer Street. Inside it, any exterior change visible from a public street or way goes to the Historic District Commission, an application must be filed with the Town Clerk before a building permit can be issued, and starting without the commission's certificate can bring a stop-work order from the Building Inspector. Like-kind repair and replacement is exempt, but the commission's posted guidelines are specific about what is not like-kind: architectural shingles replacing a 3-tab asphalt roof, for one, and for a substantial window replacement the commission says it will only consider windows with 7/8-inch muntins. It also claims jurisdiction over vents, HVAC and other mechanical equipment that protrude through the roof or alter soffits, eaves or exterior walls. Storm doors and windows, screens, window air conditioners, paint colour and roof colour are not reviewed. The town's general and zoning bylaws contain no demolition-delay provision, so demolition review applies only inside the district.

Along the shore, the Floodplain district covers the special flood hazard areas mapped as Zones A, AE, AO and VE on the Essex County flood map dated July 8, 2025. The zoning bylaw requires a permit for all construction or other development there, including changes to existing buildings, and the maps are on file with the Town Clerk, Planning Board and Building Office.

What happens if work is done without a permit?

The town can order the work stopped, opened up for inspection, corrected, or removed, and unpermitted work surfaces at sale when a buyer's attorney searches the permit history. For electrical work the state's own advice is to hire a licensed electrician to review it, pull a permit for it, and bring it up to code. It is far cheaper to permit it the first time.
