Do I need a permit in Salisbury, and who pulls it?

In Massachusetts, most permits are pulled by the licensed contractor doing the work, not the homeowner. For one- and two-family homes the state building code requires a licensed construction supervisor or a registered design professional to oversee construction, and for existing owner-occupied one- to four-family homes the contractor must also be registered with the Home Improvement Contractor program.

The homeowner exception is narrow. The building code lets an owner-occupant of a one- or two-family home apply for a building permit for work on their own home, but it applies to building permits only: electrical work may only be done by a master or journeyman electrician licensed by the state, and plumbing and gas work only by a licensed plumber or gas fitter, each under a permit issued to that licensee. It also has a cost the state warns about directly: a homeowner who pulls the building permit themselves may not be eligible for the Guaranty Fund if the contractor's work goes wrong.

The electrical side of a heat pump, mini split or AC condenser needs an electrical permit pulled by a licensed electrician. Your Salisbury building department may also require a mechanical permit for the equipment itself; the contractor pulls that too.

Heating and cooling installers are one of the trades mass.gov specifically exempts from Home Improvement Contractor registration, so do not expect an HIC number from an HVAC company. What you should expect is a gas-fitter or plumber licence for gas equipment and an electrician's licence for the wiring, with a permit on file for each.

Before you plan work in Salisbury

Salisbury permits are applied for through the town's Citizenserve e-permitting system, and an application is not approved until the Tax Collector, Assessor and DPW have signed off. The town's permitting FAQ lists siding, windows, doors, roofs, solar and decks as minor projects that still need a permit, filed with construction plans and a copy of the signed contract showing the full scope and value of the work. It requires a Mechanical/Sheet Metal permit for all HVAC work, with Manual J, D and S equipment sizing and copies of the sheet-metal licences; air-conditioning condensers must have locking caps on their refrigerant access points, and mechanical work is permitted and inspected before the rough-frame inspection.

A homeowner may pull a permit only for a one- or two-family home they live in or intend to live in, and never for electrical, plumbing or gas work, which the town says must be done by a licensed and permitted professional. A contractor improving a building with four or fewer residential units must also hold Home Improvement Contractor registration, and the town says it encourages owners to have the contractor pull the permit so licences and insurance can be verified.

Salisbury Beach, which the town defines as any property east of Old County Way, and the other mapped flood zones are subject to specific flood regulations. If the FEMA map shows a property in a flood zone it is in one regardless of the site's actual elevation; to be treated as outside the zone, a FEMA Letter of Map Amendment has to be filed and accepted before a building permit can be issued. A project in the zone may need the FEMA substantial-improvement worksheet, an elevation certificate must be provided before the occupancy inspection, and work that is normally exempt from a permit may not be exempt in a flood zone or on a coastal dune. The floodplain bylaw adopted at the October 2024 Town Meeting covers Zones A, AE, AH, AO and VE on the July 3, 2012 flood map, requires a permit for any construction or change to an existing building in the district, and names the Building Commissioner as floodplain administrator. In Salisbury the applicant schedules each inspection by calling the Building Department at 978-462-7839, attends it and provides safe access, since inspectors do not climb ladders (permit application FAQs). The Inspection Services page lists separate building, plumbing and electrical inspectors, with plumbing and gas inspections on Tuesday and Thursday from 3 to 5 pm and electrical inspections on Tuesday and Thursday from 1 to 3 pm. Everything is attached to the online Citizenserve application, with no paper submissions, and the application is routed to the health, conservation, fire and planning departments as well; the town's review checklist asks whether the project is in the Ring's Island Preservation District, and before the final inspections on a new house the applicant files a Certificate of Occupancy request in Citizenserve.
