Jersey Shore Building Permits After the REAL Rule

New Jersey's four shore counties hold 24.6% of the state's building permits and 42.6% of its new construction. That concentration is real, but a third of the new-build count comes from two inland townships filing tract paperwork at placeholder valuations, and stripping them out is what turns a volume statistic into a target list. As of July 20, 2026, every coastal application is also reviewed against a flood elevation four feet higher than the one that governed last year.

What changed in New Jersey's coastal rules on July 20, 2026?
The escape hatch closed.
The New Jersey Department of Environmental Protection adopted the Resilient Environments and Landscapes rules on January 20, 2026. The package amended four rule sets together: the Coastal Zone Management rules at N.J.A.C. 7:7, the Freshwater Wetlands Protection Act rules at N.J.A.C. 7:7A, the Stormwater Management rules at N.J.A.C. 7:8, and the Flood Hazard Area Control Act rules at N.J.A.C. 7:13.
At its centre is a single number. The rules introduce a Climate Adjusted Flood Elevation, which sets the regulatory design elevation along tidal waters at FEMA's 100-year flood elevation plus four feet. The version proposed in 2024 asked for five. The adopted rule settled on four.
Adoption came with a 180-day legacy provision. Applications that were already complete for review by the department could proceed under the prior standards, and that window ran out on July 20, 2026.
So there is now a hard line through the New Jersey coastal pipeline. Projects that got complete before the cutoff are building to the old elevation. Everything applied for since is building four feet higher, on a jurisdictional footprint that reaches further inland than FEMA's mapped flood hazard areas do, into parcels that sat in Zone X and in some cases outside mapped flood risk entirely.
That is a demand event, and it does not show up in the permit record as a rule change. It shows up as houses.
Where does shore new construction actually concentrate?
In Monmouth, Ocean, Cape May and Atlantic, and not evenly.
Those four counties hold 157,832 of the 640,741 New Jersey permits in our file. Statewide, permits recording new work are 26,998 records, or 4.2% of everything. Inside the shore counties the new-build rate runs 7.3%, about 1.7 times the state figure, and those 11,500 permits are 42.6% of every new-construction permit in New Jersey.

Read the last two columns against each other, because they disagree in a useful way. Cape May has the highest new-build share in the state and the highest median new-build cost of the four, on the smallest permit file. Monmouth has the most permits and the lowest median new-build cost. Those two counties are running different businesses, and a territory plan built on county volume alone will get that backwards.
Across the four counties, 89,544 permits carry an application date in the last twelve months, and 6,401 of those are new construction. The market is not hypothetical.
Why does the biggest new-build town not belong in this cohort?
Because Lakewood and Manalapan are not coastal.
Sort the shore counties by new-construction count and the top two results are Lakewood in Ocean County with 2,007 and Manalapan in Monmouth with 1,650. Together that is 3,657 permits, 31.8% of the entire shore new-build cohort. It is the single largest block in the data.
Look at what those permits declare and the picture falls apart. Lakewood's median new-construction cost is $5,000. Manalapan's is $1,162.50. A house does not cost $1,162.50.
What these actually are is inland tract development, filed as repeated permits against single block and lot numbers with the valuation split across them. New Jersey records the use group and the block and lot in its description field rather than a narrative of the work, a quirk covered in how every New Jersey permit carries a block and lot, and that is exactly the structure you see here: the same block appearing dozens of times. The same placeholder pattern shows up in the wider file, where the empty square footage box separates the 22,124 measured new-build permits from the 4,874 that are mostly paperwork.
Neither township sits on the coast. Neither is a Climate Adjusted Flood Elevation story. Both will dominate any count-based ranking you build.
Take them out and 7,843 permits remain. Now sort by median declared cost instead.

Ocean City files a sixth of Lakewood's new-construction count at eighty-seven times the median declared value. That is the list the elevation standard actually touches.
What does the legacy cutoff do to your pipeline?
It splits the next two years into two cohorts that want different things.
An environmental permit is not a construction permit. The department's coastal and flood hazard approvals come first, and the municipal construction permit issued under the New Jersey Uniform Construction Code comes later, sometimes much later. Our file holds the second kind. So the REAL rule does not appear in this data as an event. It appears as a slow change in what gets built, arriving months behind the regulatory date.
That lag is the opportunity. Projects that beat the July 20, 2026 cutoff are the last cohort designed to the old elevation, and they are moving into municipal permits now. Projects applied for since are the first designed to the new one, and they will start landing through 2027.
Our records carry no flag for which standard a project was reviewed under. Nothing in the file says REAL. Application date is the only proxy you have, and it is a rough one, because the gap between an environmental approval and a construction permit varies by project. Use it as a sorting hint, not a fact.
The most recent application date in the four shore counties is August 7, 2026, so New Jersey runs three to four weeks behind. That suits cohort work and territory planning. For anything where response time is the thing that matters, the 20 business day statutory clock is the sharper tool.
Which trades does a four-foot elevation change pay?
The ones that sit below the finished floor, and the ones that have to get to it.
Raising a required design elevation does not just move a number on a drawing. It changes foundation and pile work, grading, and how anyone reaches the front door, since access design has to rise with the building. Mechanical and electrical equipment that has to sit above the design flood elevation gets relocated. Stairs, ramps, decks and landings all get longer.
None of that is speculative. It follows from the elevation standard itself, and the departmental guidance around the adopted rules is explicit that finished floor elevations, access design and grading are the technical elements affected.
Demolition is the earliest signal in the sequence. The shore counties carry 3,198 demolition permits, and on a barrier island or bayfront lot a demolition is almost never a removal. It is the opening move of a teardown and rebuild that will have to meet the current standard, and it lands in the record well before the new-construction permit does. If you sell anything that goes into a rebuild, the demolition filing is your earliest warning.
Site work, drainage and hardscape follow the grading changes, which makes this a genuine outdoor and site trades opportunity rather than only a structural one. What this data cannot tell you
The limits here are specific, and pretending otherwise on a regulatory topic is how you lose a reader permanently.
We do not hold New Jersey Department of Environmental Protection permits. No coastal permit, no flood hazard area approval, no wetlands determination. What we hold is the municipal construction permit that follows, and the connection between the two is inference, not a join.
There is no elevation field, no flood zone, and no way to tell from a record whether a property sits inside the expanded flood hazard area. There is no latitude or longitude anywhere in the New Jersey file, so radius and drive-time targeting are not available and the barrier island cannot be drawn as a shape. Municipality is the finest geography you get.
No contractor name and no owner name appear on any of the 640,741 records. Street address is present on 88.4% of the file and runs below 75% in Atlantic County, which is one of the four counties this article is about.
And declared project cost is the cost of work stated to the construction official. It sits well below what an owner pays under contract. Every figure here is a median for that reason, because 23,239 New Jersey records carry a project cost under one hundred dollars and averages do not survive them.
